The two teachers who were fired over an alleged lesbian tryst in a Brooklyn classroom have slapped the city of New York with a $2 million lawsuit.  More from The Advocate: 

Filed Wednesday in Manhattan supreme court, the two-page summons calls Alini Brito and Cindy Mauro victims of “wrongful termination, libel and slander.”

The Department of Education sacked the two foreign language teachers after a state arbitrator’s report accused them of engaging in a sexual encounter at James Madison High School during a student talent show. According to the report, a janitor walked into room 337 and observed a naked Mauro kneeling between a topless Brito’s legs. But the women tell an altogether different story. Brito, who has diabetes, said Mauro was simply giving her candy to treat her blood sugar level.

“They’ve had to deal with these false allegations of engaging in lesbian sex,” said their attorney, Michael Valentine. “It’s been painful.”

While the janitor reportedly told several school employees about the sex he had “witnessed,” Valentine says the janitor’s version of events changed when he was put on the stand. “He admitted in his hearing testimony that he only saw one person, but speculated there were two women in there having sex,” Valentine said. “When does a fish become a whale?”
